1. APPLICATION OF TERMS

Thank you for visiting our website. This website is owned and operated by Aesthetik Pty Ltd ABN 80 386 116 028.

By accessing and/or using our website and related products and services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.

These Terms apply to your use of aesthetik.com.au (“the Website”).

You agree to be bound by these terms and conditions.

We may amend these terms and conditions from time to time and these changes will be deemed to be immediately incorporated into and form part of these Terms. By continuing to visit and use our website and purchase our products and services, you will signify your agreement to be bound by the amended Terms. We encourage you to read our Terms and check back often.

2. THESE TERMS ARE GOVERNED BY THE LAWS OF AUSTRALIA.

In these Terms:

Including and similar words do not imply any limit.

Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis.

Personal information means information about an identifiable, living person.

Terms means these terms and conditions titled Website Terms of Use.

We, us or our means Aesthetik Pty Ltd.

You means you or, both you and the person on whose behalf you are acting.

4. ABILITY TO ACCEPT TERMS

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

5. COLLECTION

We may collect personal information about you in order to provide our services, such as responding to your enquiry or processing a request, and for other purposes as detailed in our Privacy Policy. We may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services and products to you. Our Privacy Policy explains:

how we store and use, and how you may access and correct your personal information;
how you can lodge a complaint regarding the handling of your personal information; and

By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.

6. PRODUCTS & SERVICES

We offer all services and products as set out on the Website.

We reserve the right to amend the prices of our products and services at any time.

All items are subject to availability. We will inform you as soon as possible if the products you have ordered are not available.

7.PAYMENT METHODS

We accept payment via the following payment methods:

Paypal
selected credit cards such as Mastercard and Visa
Afterpay
Zip pay
Humm
Eway

We have partnered with Afterpay, Zippay, Humm and Eway to make it easier for you to buy now and pay later. If you select any of the afformntioed external payment plan comanys as your payment option, you agree to their individual terms and Conditions provided to you through the checkout process. The Terms and Conditions are also available directly through their website.

All pricing is in AUD. Prices are subject to change without prior notification and may differ from other sites, stockists or providers.

8. CANCELLATIONS AND REFUNDS

Bookings will not be effective until confirmed in writing by us.

If you wish to cancel or reschedule the following fees will apply:

Less than 48 hours notice of cancellation or rescheduling: a cancellation fee equal to 25% of the cost of the booking will be payable.
Any deposit paid will be forfeited upon cancellation by you and will be used to satisfy the cancellation fee payable (or part thereof).

A cancellation fee will apply regardless of whether a deposit has been received.

If our service is cancelled by us, no cancellation fee will be payable and you may have the option of rescheduling or receiving a refund in full with no deductions or fees applicable.

Treatments/services are not transferable to other individuals or clinics
We require at least 48 hours’ notice to be given for any appointment cancellation
If you cancel within 48 hours of your appointment, or do not attend a booked appointment, we reserve the right to retain your deposit
If you consent to proceed forward with an elective cosmetic treatment and have paid a deposit, once you have signs your waiver form, you agree to proceeding forward with your treatment choice
Therefore no refunds can be given to your treatment as external suppliers have been paid. A refund will not be issued and full payment of the treatment service is to be accounted for
In the case of pre-paid treatments, the full cost of treatment will be forfeited
Refunds will be provided where required in accordance with the Australian Consumer Law. We want you to be a satisfied client so if our service or product is faulty it may either be replaced or refunded. We don’t refund for change of mind. Refunds may take up to 30 days to be processed. If a refund is granted and the agreement is terminated, a processing fee of 1.5% will be applicable to all in-house payments, third-party administration fees, Super Care, or any other external payment agency platforms. Any Administration fee’s paid are non refundable.
Our procedures and products may not be suitable for you and whilst all due care and skill is exercised in treating our clients ultimately it is your responsibility to determine if the product or treatment is right for you.
Results may vary per individual for treatment and therefore you agree to our terms and conditions for proceeding with treatment. On this basis no refunds are provided.
In order for us to provide you with a great service it is fundamental that you provide all information requested in completing consent forms or advising us of any factors that may affect your treatments. You also need to have realistic expectations of the results of treatment. We encourage you to work with your practitioner on what you can achieve with your treatment.
You agree to these terms by purchasing and proceeding with your treatment.
A $50 deposit is required for all consultations. The deposit is refunded if you don’t proceed (this is to secure your appointment as we have a waitlist of patients) consultation process may be split over 2 visits and you may be required to attend both in order for your deposit to be refunded (we spend a lot of time formulating your treatment plan and showcasing to you what your end results would look like through our smile simulation. If you go ahead this is then it is redeemable towards your treatment.

Prepaid Treatment

If you pre-pay for treatments you will save an amount according to the pre-payment schedule. There is no refund on pre-pays and they are not transferable to other individuals, treatment areas or clinics.
Pre-pays have a 12 month expiry date (less than 10 treatments) or an 18 month expiry date (10 or more treatments).
48 hours’ notice is required for any pre-paid appointment cancellations. If you cancel a pre-paid appointment within 48 hours, or do not attend the appointment, the treatment will be forfeited.
You agree to these terms by purchasing pre-paid treatments.

Purchases made through Customer Portal Online

Treatments purchased online by you through the Customer Portal, continue to be regulated by Aesthetik conditions of use; privacy policy; cancellation and refund policy.
Treatments purchased online are not transferable to other individuals, treatment areas or clinics.
48 hours’ notice is required for any online purchased treatment appointment cancellations. If you cancel an online purchased treatment appointment within 48 hours, or do not attend the appointment, the treatment will be forfeited.
Refunds will be provided where required in accordance with the Australian Consumer Law. We want you to be a satisfied client so if our service or product is faulty it may either be replaced or refunded.
We don’t refund for change of mind, however, we may use our discretion if we believe the treatments purchased by you, cannot be provided to you (eg, genetic conditions deemed as unsuitable for the treatment you purchased).
Any request for refund by you, for treatments purchased online through your customer portal, must be made in writing and issued to: refundrequest@aesthetik.com.au, for our consideration. The clinic may decide, upon review of your written request, whether a refund is required

Price match

At Aesthetik we will offer to match a competitor’s price for the same treatment provided it is using the same equipment and/or products and carried out by appropriately qualified staff.

The Price Match Policy only applies to competitors that offer the same product and treatment plan. The Price Match Policy does not apply to prices offered by any competitors’ on discount sites such as groupon via an online shopping/retail website. The Price Match Policy does not apply to offers made by competitors from group buying, discount or coupon websites.

Clients must provide proof of the competitor’s price via a custom treatment plan formulated for the patient which must be current when seeking to price match and Aesthetik may take further steps to confirm the validity of the price to be matched.

Clients must mention the Price Match Policy at the time of purchase and or at the time of paying for their treatment or product. The Price Match Policy will not be applied where the products and/or treatments have already been paid for or received. Once treatment has commenced you are agreeing to Aesthetiks price and treatment.

Our Price Match Policy does not apply to our already discounted, promotional or sale treatment.

Pay in full discount

5% discount on upfront payment on treatment from $3,500 and above. The 5% discount does not apply to split payments and is only valid for one transaction. Pay in full discount does not apply to Invisalign Flex, admin fees, payment plans and is not valid with any other offer.

9.INTELLECTUAL PROPERTY

The Website and its content and our products contain intellectual property owned by us, including trademarks, copyrights, proprietary information and other intellectual property.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of our intellectual property, in whole or in part, without our prior written consent.

10.DISCLAIMERS

To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss.

We make no representation or warranty that the Website is appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable local laws.

The Website, our products and all blog articles, resources, tools, and other resources on the Website are educational and informational resources only and are not a substitute for any kind of professional or specialist advice. We cannot guarantee the outcome of following any recommendations provided and any statements made regarding the potential outcomes are expressions of opinion only.

By continuing to use and read our website and all blog articles, resources, tools, and other resources, and by buying and using our products, you acknowledge that we cannot guarantee any particular results, as such outcomes are based on subjective factors that are not within our control. Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it).

On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of Australia. Each party submits to the non-exclusive jurisdiction of the Courts of Australia in relation to any dispute connected with these Terms or the Website.

For us to waive a right under these Terms, the waiver must be in writing.

Clauses which, by their nature, are intended to survive termination of these Terms, including clauses, 9, 10, 11, continue in force.

If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these Terms. The remainder of these Terms will be binding on you.

These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.

Perfect Pair Whitening

Perfect Pair Invisalign

Perfect pair Invisalign promotion: Our Perfect pair Invisalign package offers $500 discount off the combined Invisalign value when you secure two Full or complex Invisalign treatments on the same day. Bridal Package Whitening

Bridal package: Book and pay for teeth whitening treatment for three people at a cost of $395 per person. Receive a fourth teeth whitening treatment valued at $395 and a teeth whitening strips valued at $29.95 for free. Offer not transferable for cash or any other product or service. All four bookings must be made together. Valid until Dec 2024

$100 Credit towards dental treatment

$100 credit used towards any general dental treatment. Can not be used with any other discounts or offers. Offer not transferable or redeemable for cash or any other product or service. Applies to all outstanding patient treatment plans over $500.00 (Not yet booked in). Valid 28/07/24 – 31/08/24.
